How do I become a member of THE GRAYIST community?
Go to the Membership Page and click on the membership button. Once you purchased a membership, a member from THE GRAYIST will personally reach out to you and welcome you with onboarding instructions.
What type of artist can become a member of THE GRAYIST?

THEGRAYIST.com Terms & Conditions
This web placement agreement (“Agreement”) begins on the date of subscription purchase and ends with the expiration of the subscription’s paid time period.
Subscription purchaser (“Artist”) with the email address provided in the checkout process
THEGRAYIST.com (“Website Owner”) with a mailing address of 342 East 100th Street, NY, NY 10029 and 208 N Third Street, Wolcott, IN 47995.
For and in consideration of the mutual promises and stipulations contained in this Agreement, Website Owner does hereby place image(s) and text from the Artist on THEGRAYIST.com, and the Artist hereby rents from Website Owner, the site space premises described the selected package purchased upon the following terms and conditions.
- Website placement. The digital space to which this Agreement relates is located within the url: THEGRAYIST.com and associated social media accounts. Placement within each is outlined in the package description purchased
- Term of Agreement.
Month-to-month. This Agreement shall begin on the date of package purchase and continue on a month-to-month basis until further notice of Artist or Website Owner. Either party may terminate this agreement upon a 3-business day written notice served on either party.
A discount can be applied at the Website Owner’s discretion for contracts of 12 months or more. If contract is canceled prior to completion, discount is forfeited and full month-to-month charge will be incurred prior to refund of remaining balance.
- Payment of subscription. All subscription payments shall be paid via the website checkout. Refunds will be issued once balance has transferred to THEGRAYIST.com account. THEGRAYIST.com does not take commission from any sales or handle any transactions on behalf of the Artist. Artist commits to donating 5% of their sales to a non-profit of their choosing. Non-profits deemed inappropriate by THEGRAYIST.com will require the Artist to select a different organization or be removed from the website entirely.
THEGRAYIST.com commits to donating 5% of annual profits to a non-profit of its choosing and another 5% of annual profits to be shared back to the subscribing artists based on level and duration of that year’s subscription.
- Condition of the digital space. Artist agrees to accept the website in its present condition. Digital space is subject to upgrades and revisions as required by site host and technical vendors.
- Use of THEGRAYIST.com subscription. Artist shall use the website as a promoter of their social account and/or website solely for the use of providing services rendered in person or selling product they have made by hand. Artists reselling items deemed to be primarily manufactured by a third party will forfeit contract and all fees paid.
Artist shall not use the assets nor permit the assets to be used, in any manner that violates any law, statute, ordinance or regulation now or hereafter in force and applicable to the digital space. Artist and Artist’s agents shall at all times comply with all rules and regulations of Lessor in existence.
VII. Digital Assets. THEGRAYIST.com retains all rights to logo and marks. Usage of the logo and marks by the Artist in any way deemed inappropriate by THEGRAYIST.com will result in forfeiture of contract and fees paid. Artist agrees to provide the Website Owner assets that they have the rights to use. Website Owner will make every effort to publish gallery listings within 10 business days of receiving the first set of assets from the Artist after subscription payment. This assumes timely responses by the Artist to any questions from THEGRAYIST.com. Subsequent revisions and update requests from the Artist will be subject to the same timeline.
VIII. Artist and Website Owner to maintain goodwill. The both parties agree to honor the original intent of THEGRAYIST.com as a place of positive support for makers at all levels to promote themselves and each other. Maintaining the spirit of kindness generated by the donation commitment in all communication about THEGRAYIST.com, associated artists, and their work in all public forums.
XII. Indemnity by Artist. Artist covenants and agrees to hold the Website Owner harmless from any and all loss, claims, damage, and liability to any person or property occurring upon or about THEGRAYIST.com and associated social accounts from any cause whatsoever.
XIII. Default by Artist: If Artist shall default in any covenant or agreement to be performed by Artist under this agreement, and if after written notice has been sent by the Website Owner to the Artist, such default shall continue for a period of 3 business days, or if the Artist shall petition to be or be declared bankrupt or insolvent according to law or make any conveyance or general assignment for the benefit of creditors or if a receiver be appointed for Artist’s property and such appointment is not vacated and set aside within 3 business days from the date of such appointment, or if proceedings for reorganization, arrangement, composition or other proceedings with creditors be instituted by or against the Artist, then, and in any of such events, Website Owner may immediately or at any time thereafter, and without further notice or demand, forfeit contract and any refund rights.
XIV. Severability. The invalidity of any portion of this Agreement will not and shall not be deemed to affect the validity of any other provision. If any provision of this Agreement is held to be invalid, the parties agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed by both parties subsequent to the expungement of the invalid provision.
- No Waiver. The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred.
XVI. Governing Law. This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Indiana.
XVII. Notices. Any notice provided for or concerning this Agreement shall be in writing and shall be deemed sufficiently given when sent by email if sent to the respective address of each party as set forth at the beginning of this Agreement.
XVII. Mandatory Arbitration: Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then decide a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
XVIII. Assignment of Rights. The rights of each party under this Agreement are personal to that party and may not be assigned or transferred to any other person, firm, corporation, or other entity without the prior, express, and written consent of the other party.
XIX. Modification of Agreement: Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party.
XXV. Entire Agreement: This Agreement shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement.
